The principal United Kingdom website and Portal operator is SEMPER EADEM LTD, a private limited company registered in the United Kingdom under company number 13285107, with registered office at 167–169 Great Portland Street, 5th Floor, London, United Kingdom, W1W 5PF (“Semper Eadem”, “we”, “us”). The official record is available from Companies House. A password-protected, non-indexed test environment is not a public market launch and must not accept live customer orders or public photo submissions.

These Terms govern use of the website. Creating a personal look requires an affirmative statement at the point of upload: “I have read and agree to the Portal Terms.” The Portal may remember acceptance of this exact Terms version and the same private-generation purpose in Privacy & Permissions so it does not ask the same questions before every generation. A new version, a new purpose or a withdrawn choice requires a new decision. The separate batch confirmation that the visitor is 18 or over and has authority to use the photographs is required for each new batch.
Generation is private by default. Agreeing to generation does not agree to publication, advertising or endorsement use. “MAKE PUBLIC” on a particular kept look is the separate publication decision for that look.
Neither choice waives rights that cannot legally be waived or makes an unfair or unlawful term enforceable. You must be at least 18 and legally able to agree, or older if the age of majority where you live is higher. Do not upload photographs of anyone under 18.
Your photograph warranty. For every file you submit, you promise that you are the person depicted or that every identifiable adult depicted has knowingly and expressly authorised the exact use you select. You also promise that you took the photograph, own or control the necessary copyright, or have the copyright owner’s permission to upload, copy, process and create the requested result. Private AI generation, public publication and Media + Shopping are different scopes: permission for one does not prove permission for another. You must not submit a photograph copied, scraped, purchased or received from another person unless both the depicted-person rights and the photograph copyright are cleared for the exact selected scope.
No unauthorised third-party or celebrity photographs. Do not upload a minor, a secretly photographed person, a former partner, a customer, an employee, a model, a public figure, a celebrity or any other third party without the specific authority required for the selected use. A photograph being public, online, newsworthy, old, available through a search engine or associated with a famous person does not by itself grant copyright, privacy, publicity, likeness, trade-mark or endorsement permission. You must not state or imply that a person approves, wears, buys or endorses Semper Eadem unless separately authorised in writing.
Fresh confirmation before public use. The upload confirmation covers only the stated private generation. Before “MAKE PUBLIC”, you must separately confirm for that exact look that every intentionally depicted adult authorised public website, @1886.London, sharing and search-engine availability. Media + Shopping remains a further separate unticked permission. Semper Eadem may request reasonable evidence, refuse or quarantine a submission, stop generation, restrict or remove a look, disable further submissions, preserve a minimum lawful audit record and cooperate with a valid rights claim or lawful authority.
Your responsibility for a false promise. You are responsible for content you submit and for a knowing or negligent breach of the promises above. To the maximum extent permitted by applicable law, you must reimburse Semper Eadem for direct, reasonable and documented losses, damages and external legal costs finally awarded or reasonably incurred in responding to a third-party claim, but only to the extent caused by your breach. We will give reasonable notice of the claim and a reasonable opportunity to participate in its defence or settlement. This does not make you responsible for Semper Eadem’s unauthorised use, use outside the permission you granted, negligence, failure to act after a legally sufficient notice, or breach of mandatory law; it does not exclude liability or rights that cannot lawfully be excluded. An overbroad or unlawful transfer of responsibility is not made valid by these Terms.
The Portal may use an artificial-intelligence service to create user-directed fashion images from photographs you choose. Generated looks are creative interpretations: they may be inaccurate, non-unique or unsuitable, and are not identity verification, professional advice or a statement about any real person.
Private generation and public publication are different actions. Generation is private by default. The current unconnected preview uses editorial placeholders and does not count as a completed live generation. Live upload remains disabled until the approved business API, processor terms, security, deletion period and international-transfer safeguards are configured and disclosed at the point of collection.
Uploaded photo files are re-encoded in the browser before the Portal sends them, which removes ordinary embedded metadata such as EXIF. The generation provider must not use the files to identify people, create biometric templates, train a general model, advertise to users or use them for a new purpose. The Portal does not intentionally collect face geometry or perform facial recognition.
A distinct confirmed paid purchase through the principal website checkout, Shopify or a paid pre-order/deposit adds 10 Portal generation rounds to the client email used for that purchase. One round requests three private, AI-labelled live looks. A later distinct paid purchase adds another 10. Duplicate payment notifications do not add credit twice. Visitors without client credit may still receive clearly labelled editorial previews, but cannot call the paid live generator.
A refund, void, cancellation or chargeback may remove up to the unused credit granted by that purchase. Credit has no cash value, cannot be sold or used to buy products, does not improve recommendation ranking or public visibility, and does not make one person’s story more important than another. Mandatory refund and consumer rights remain unaffected.
Client access uses a time-limited passwordless link sent to the purchase email. For security and privacy, the public form gives the same response whether or not an address is recognised. Live client credit remains unavailable until signed payment webhooks, magic-link delivery and the generation processor are configured.
Every personal generated look is visibly marked “AI GENERATED · USER DIRECTED” or, when it is not a live output, “AI PREVIEW”. Do not remove or conceal that disclosure when sharing the image. The connected generation provider must also support the machine-readable marking and provenance requirements applicable to its service.
Personal looks remain private unless you make a separate, affirmative choice for an individual kept look to be public. Before “MAKE PUBLIC” can be selected, the Portal requires an unticked exact-look confirmation that the source photographs and every depicted adult are authorised for public website, @1886.London and search-engine use, and shows a short public notice explaining the audience, search-engine availability and removal limits. Pressing “MAKE PUBLIC” is the affirmative per-look publication request; there is no pre-selected or bundled public setting. Leaving it unchanged keeps the look private and does not prevent private generation, saving, deletion, buying or pre-ordering.
What public means. If publication is confirmed, the selected look and its branded Semper Eadem frame may be available to anyone on the Semper Eadem website, public Portal, public feeds, directly related story pages and the launch Instagram account @1886.London. Semper Eadem may present it in Instagram posts, carousels, Stories, Reels, Highlights, profile and feed surfaces, and it may also appear through Instagram or Meta recommendations, search, sharing and embedding features. People may view, link to, screenshot, download, copy, forward, repost, embed, crop, remix, add text or audio to, edit or otherwise share publicly accessible copies. Semper Eadem cannot practically prevent every such action.
Semper Eadem may also make the public page and image technically available to Google, Bing and other search engines, image-search services, crawlers, social or messaging previews and comparable discovery services. They may index the page or image and create thumbnails, snippets, previews or temporary cached copies under their own systems and terms. Appearance, recommendation or ranking is not guaranteed. Making a look public does not transfer your ownership to other people, waive copyright, privacy or publicity rights, grant the public a blanket licence, or make an unlawful, infringing, deceptive or harassing use lawful.
Separate publication choice. Immediately beside the per-look action, the Portal states that a public look may appear on Semper Eadem, @1886.London, Google and other search engines; may be shown in posts, Stories, Reels, image results, previews, links, embeds and caches; and may be screenshotted, downloaded, copied, reposted, embedded, remixed, edited or shared by other people. Removal from Semper Eadem or Instagram may not immediately remove third-party results or copies. Pressing “MAKE PUBLIC” records that individual decision. It is only a publication request and is not reported as published until moderation and public storage confirm that the look is live.
Limited public-display licence. If publication is confirmed, you grant Semper Eadem a non-exclusive, worldwide, royalty-free licence, while the look remains public, to host, store, re-encode, crop, technically reproduce, display, make available and distribute that selected look and its branded derivative through the public website, Portal, related story page, public feed, sitemap, structured data, search-engine discovery, social or messaging link previews, and organic posts, carousels, Stories, Reels and Highlights on the official @1886.London account for the public Portal launch and its directly related editorial promotion. You keep your rights: this is a licence, not a transfer of ownership. By itself, public publication does not permit a separate paid advertising campaign, a claimed endorsement, general-model training, sale of the look as a standalone asset or a new unrelated use.
Optional Media + Shopping release. Public publication and promotional media use are separate choices. If you select the separate unticked “MEDIA + SHOPPING” box for selected public look(s), you grant Semper Eadem and its contractors, production vendors, advertising agencies and media platforms acting for Semper Eadem a non-exclusive, worldwide, royalty-free licence, for the maximum duration permitted by applicable law and subject to the withdrawal terms below, to use those look(s) and branded derivatives to advertise, market and promote Semper Eadem, the Portal, Semper Eadem products, services, launches, events and collaborations, and in editorial, public-relations, exhibition, cultural and entertainment material. The same choice permits BUY or PRE-ORDER beside the selected public user look and, once the release is recorded, creates a measured referral link tied to that look.
That optional licence permits Semper Eadem to reproduce, publish, display, distribute, communicate, crop, resize, reframe, colour-grade, retouch, composite, animate, translate and caption the selected look; add branding, graphics, text, music, voice or other audio; combine it with other material; and place it in organic or paid social media, search and display advertising, websites, apps, email, press, presentations, exhibitions, events, outdoor media, printed matter and other current or future media. Service providers receive only the rights needed to create, place, distribute, measure or archive Semper Eadem material; they may not sell the look as a standalone asset, use it for an unrelated client or train a general model on it.
Unless a separate written agreement says otherwise, no fee, royalty, attribution, further inspection or approval is due for a use within that optional licence, and Semper Eadem is not obliged to use the look. By selecting the release, you confirm that you are at least 18 and every real adult intentionally depicted has authorised the stated commercial use. It does not permit a false endorsement: Semper Eadem may not invent a quotation, product experience or personal opinion, falsely present a depicted person as a spokesperson, or use the look in an unlawful, defamatory, discriminatory, political, sexual, medical or similarly sensitive context.
Measured referral and possible invitation. The linked referral may record first-party visits, likes, public UGC additions and attributable sales or reversals. Semper Eadem may use these results to organise a private human-reviewed shortlist and may invite selected adults to a creator or referral test. A link, score, email submission or level of activity does not guarantee contact, enrolment, a gift, payment or any particular offer. Email contact requires a separate affirmative contact choice. Semper Eadem does not use protected traits or image-based inferences to select candidates.
What grants commercial use. The recorded Media + Shopping release above, or a separate active written referral agreement that expressly identifies the look and commercial-use scope, may supply the required permission. An ordinary share link, candidate link, click, like, public post, email submission, purchase or referral parameter by itself does not grant commercial-use rights. A referral link backed by the recorded Media + Shopping release carries that recorded permission for the linked look; it does not extend the permission to unrelated works.
Advertising classification and withdrawal. Paying for a generation, buying or receiving a product, or presenting material as experience, entertainment, editorial or art does not by itself decide whether a brand-controlled placement is advertising. Required commercial, affiliate and material-connection disclosures remain separate obligations; a creator must not conceal a commercial relationship when law or platform rules require disclosure. Where applicable law permits withdrawal, an approved request stops new controlled promotional uses and disables new commercial retail placement under the withdrawn grant after processing, without retrospectively invalidating completed authorised use or guaranteeing recall of print runs, platform caches or third-party copies. Ordinary public visibility may remain separately unless it is also restricted or deleted.
Private shopping. The owner may BUY or PRE-ORDER a product configuration inspired by a private look without publishing the image. The stock or checkout adapter receives only the market, look reference, colour/style and product or SKU fields needed for availability; it does not receive the private image URL. A purchase, order, receipt or generation credit never makes a look public and never grants publication, advertising or endorsement rights.
The Portal may retain the limited public-display licence while the look remains public. An approved restriction, deletion, safety or copyright request ends Semper Eadem’s future public display to the extent required by the applicable decision and law. A licence cannot remove mandatory privacy, consumer, publicity, copyright or safety rights.
Same-browser control. When a look is actually published, the publication service issues a random owner capability to the publishing browser. The server stores only its one-way hash. If that capability is still present, the Portal may show controls on that specific public look and can restrict public visibility or delete the look without asking for a face scan. Clearing browser storage, changing browser or changing device may remove this shortcut; it is not the only rights route.
Private review route. Anyone without the capability may use the Portal look control form to request restriction or deletion. The form asks for the public look ID or URL, approximate upload date, a contact email, the claimant’s role and the least intrusive proof reasonably available. Depending on the claim, useful proof may be control of the original email, non-public upload facts, the original file, a temporary random code placed on a public social profile, or authority to act for another person. A screenshot supports a claim but is not conclusive by itself. We do not require social-media membership and do not use facial recognition or biometric matching.
Temporary restriction and abuse prevention. A verified same-browser restriction takes effect directly. A credible urgent claim involving a minor, non-consensual or intimate imagery, impersonation, threat or comparable safety risk may receive a provisional hold while it is checked. An unsupported anonymous request does not automatically hide another person’s work. Semper Eadem may request only the additional information reasonably necessary to verify identity, authority or ownership, and may refuse a request that cannot be sufficiently verified where law allows.
GPT triage; human decision. GPT may create a structured summary of the written claim, regional route, urgency, risk flags and missing evidence. Raw evidence files and contact email are not sent to GPT. GPT does not authenticate a person, decide copyright or ownership, perform a facial comparison, or approve deletion. A human reviewer makes the final decision, except for a valid same-browser capability exercising its direct control.
Records. Private evidence files are kept separately from public images and are scheduled for deletion 30 days after a final decision, unless a longer legal hold is necessary. A minimal request, decision and audit record may be retained for up to 24 months to demonstrate compliance, prevent repeat publication, handle an appeal or defend a legal claim.
Search engines and third-party copies. When a public look is restricted or deleted, Semper Eadem will remove or block the source under its control and, where appropriate, may request a search-engine refresh or removal. Search engines, archives, social platforms, messaging services and people who previously copied or shared the look are outside Semper Eadem’s direct control. Their results, caches, previews or copies may therefore remain for a period of time or require a separate request. Semper Eadem cannot promise deletion from systems it does not control.
The feed draws candidates from approved editorial looks, fresh moderated community looks, personal results and a small exploration pool. It scores aggregate signals such as meaningful viewing, likes, shares, skips and progress toward the three Portal goals, then re-ranks for freshness, no repetition and colour/style variety.
The system does not use photograph contents, inferred race, ethnicity, sex, gender, disability, religion, age or other protected characteristics to rank people. Every visitor enters the same candidate, scoring and re-ranking rules. Popularity does not guarantee placement. More detail is available in the Recommendation notice.
The official worldwide account for the Portal launch is @1886.London. If you separately make a look public, Semper Eadem may post the look and its branded frame to that account in the organic Instagram formats described in section 5. Instagram and Meta are third-party services with their own terms, privacy practices, recommendation systems and public-account controls.
Depending on Instagram’s current settings and features, other people may be able to share a public post to Stories, embed it on another site, screenshot or download it, or reuse all or part of it in a remix, sequence, template or sticker and add their own edits, text or audio. Account controls may reduce future embedding, resharing or reuse, but cannot reliably recall screenshots, downloads, reposts, remixes or copies already made. Public availability does not give another person ownership or a general legal permission to use the look however they wish.
Opening the profile is not treated as proof of a follow. Goal 3 is counted only after a valid Meta-side verification. Semper Eadem is not sponsored or endorsed by Instagram or Meta unless expressly stated.
Optional first-party analytics runs only after an affirmative choice. Refusing it does not remove Portal access. Analytics excludes photographs, image contents, names, emails, client identifiers, order references, prices, Instagram identities, free text and protected characteristics. Purchase history never changes recommendation ranking. We do not sell or share personal information for cross-context behavioural advertising and do not use targeted-advertising cookies.
Privacy rights, retention, Global Privacy Control and regional contacts are described in the Privacy notice. Privacy choices are separate from these Terms and may be changed at any time.
Essential service messages are not marketing. Semper Eadem may send a narrowly necessary account, security, requested-access, transaction, generation-credit, rights, withdrawal or material service/legal message where the applicable service or law requires it. These messages must not contain offers, editorial promotion, invitations or cross-selling. A purchase, account, birthday, referral link, publication choice or Media + Shopping permission does not subscribe anyone to optional email.
Optional email choices. Birthday postcards, new stories and features, private invitations, and offers, launches and events are four separate optional email categories. Every category starts off and requires a clear affirmative choice for the exact email address. “Allow all optional emails” may enable those four email categories only. “Essential only” and “Unsubscribe from all optional emails” turn every optional email category off. Refusing or withdrawing optional email does not remove ordinary service access or affect an independently controlled public look.
Birthday postcards. If an adult has separately selected birthday postcard email and supplied a birthday day and month for that purpose, Semper Eadem may send at most one annual birthday greeting and postcard, apart from a necessary delivery retry. A birth year is not required merely to send the greeting, and age or protected traits are not inferred. Without an active birthday-email choice, no birthday marketing is sent.
Image permission is separate. The default birthday artwork does not depict the recipient. A newly generated or personalised scene depicting the recipient requires a separate current exact-person, exact-source, provider and exact-use permission for that private birthday email. Email consent never supplies likeness, generation, publication or Media + Shopping rights; an image, publication or Media + Shopping permission never subscribes the person to email. If either permission is absent or withdrawn, Semper Eadem uses non-likeness artwork or sends nothing.
Simple preference centre and unsubscribe. Before any optional message is activated, a working /v25/subscription-preferences.html page must let a person choose essential only, allow all optional emails, change each category, unsubscribe from all optional emails in one step and later subscribe again by a fresh affirmative action. Every optional email must identify the sender, explain its category and contain a direct preference link and prominent unsubscribe-all route. Reducing choices must not require a purchase, new account, password-recovery journey, survey, fee or extra personal information beyond a proportionate security check. Semper Eadem stops the affected sends promptly, applies a protected suppression record and honours the shortest applicable regional deadline.
No hidden measurement. An email-category choice does not enable tracking pixels or identified open/click measurement. Any later measurement requires its own transparent privacy and consent route. Raw email, birthday, preferences, message tokens and delivery outcomes do not enter Site or Portal Analytics, and a postcard or recipient code never becomes analytics identity.
Printed postcards are future and separate. Postal birthday cards remain disabled. Email consent does not permit use of an order or delivery address for birthday post. Printed delivery requires a separate unticked postal choice and a later notice identifying the address purpose, printer/fulfilment and delivery providers, regions, transfers, retention, returned-mail and deletion rules.
The optional messaging service remains disabled until the preference centre, server-side consent and suppression ledger, provider controls, accessibility, retention/deletion routes, seed-list tests and qualified review for every actual target market are complete. These Terms describe the required boundary; they do not claim that the page or sending service is live.
Do not submit illegal, deceptive, hateful, exploitative, non-consensual, infringing or malicious material; photographs of minors; intimate imagery; government identifiers; or material intended to identify, rank or make consequential decisions about a person. Do not probe, scrape, overload, bypass security or automate the Portal without written permission.
The website, Portal design, Semper Eadem name, marks, editorial looks, text, software and brand assets belong to Semper Eadem or its licensors. Except for the limited sharing functions provided, no rights are transferred. Your pre-existing rights in an authorised uploaded photograph remain yours.
The preview may change, pause or contain errors. To the maximum extent law permits, it is provided without a promise of uninterrupted availability or that a generated output will meet a particular purpose. Nothing excludes liability that cannot lawfully be excluded, including mandatory consumer rights, fraud, or liability for death or personal injury caused by negligence where applicable.
The common Terms above apply worldwide. Only the relevant addendum is shown by default; all addenda remain available through the selector. A different law may still apply because of residence, business establishment, targeting or another legal connection.
Mandatory UK consumer and data-protection protections continue to apply. Consent for optional analytics and publication must remain specific and separate from access to a service where it is not necessary. Unfair, hidden or excessively broad terms do not become enforceable merely because they appear in these Terms. Privacy, copyright, passing-off, advertising and consumer-protection obligations remain separate from an image licence.
Mandatory consumer protections and data-protection rights continue to apply. Where applicable, a person may request erasure or restriction, object, or withdraw consent. We normally respond without undue delay and within one month after a sufficiently verified request; a lawful extension or exception may apply. If there are reasonable doubts about identity, only additional information reasonably necessary to confirm the requester may be requested. Restriction may be used while accuracy, objection or entitlement is checked.
Where the EU Digital Services Act applies to a Portal function, users may receive clear moderation reasons and a route to challenge a content decision. Applicable AI-generated-content disclosures are presented at the point the content is shown.
Applicable state rights—including access, correction, deletion and opt-out rights—are not waived. Requests are verified to the degree required by the applicable state law. For California requests within the CCPA, receipt is generally confirmed within 10 business days and a verified request answered within 45 calendar days, subject to a permitted extension and exceptions.
A copyright takedown is a different route from a privacy or likeness request. A person shown in a photograph is not necessarily its copyright owner; the photographer or authorised copyright agent may use the applicable copyright notice route, including a legally sufficient DMCA notice where relevant. Global Privacy Control is recognised. The Portal does not sell personal information, share it for cross-context behavioural advertising, create biometric identifiers or knowingly collect photographs from children.
Meaningful consent, limiting collection, access, correction, withdrawal and complaint rights continue to apply. Consent may be withdrawn subject to reasonable notice and lawful or contractual limits; an existing Portal licence does not erase those mandatory rights. We respond within the period required by the applicable federal or provincial law after sufficient verification and retain only the minimum record needed for accountability or a legal claim.
Privacy is set to the highest level by default. A privacy impact assessment and written safeguards must be completed before personal information is communicated outside Québec where required.
Applicable privacy, consumer and advertising protections continue to apply. Personal information is collected and used only for the purposes presented, appropriate security and processor oversight are required, and cross-border handling must follow applicable disclosure and consent rules. Brand-controlled promotion, testimonials and material commercial relationships must not be presented in a way that misleads people about their advertising character.
The common Terms and privacy baseline apply. Mandatory consumer and privacy rights in your residence or the market actively served by Semper Eadem remain unaffected.
2026-08-15.7. Added the per-upload photograph, depicted-person and copyright warranty; prohibited unauthorised third-party and celebrity photographs; added a separate exact-look authority confirmation before public publication; recorded a proportionate responsibility and reimbursement clause for losses caused by a user’s false promise; and preserved Semper Eadem’s own mandatory duties, removal route and non-excludable rights.
