Terms & Conditions
The full Website & Portal Terms cover personal photo generation, AI disclosure, private-by-default settings, public visibility, moderation, recommendations, Instagram, regional rights and sharing.
The principal United Kingdom operator is Semper Eadem Ltd, company number 13285107, registered office 167–169 Great Portland Street, 5th Floor, London, United Kingdom, W1W 5PF. Separate governing-law, regional operator/seller, sales, shipping, return and product-care terms are still required before the relevant public market takes orders.
Privacy notice
Controller. Semper Eadem is the controller, subject to the verified operator details on the Company page. Privacy enquiries, access, correction, deletion, withdrawal, objection or complaint requests may be sent to hello@sempereadem.uk.
Personal generation and remembered choices. Upload is limited to adults aged 18 or over using authorised photographs of adults. For every new batch, the visitor must confirm that each photograph depicts them or that every depicted adult expressly authorised the private AI use, and that the visitor owns the file or has the copyright owner’s permission. The generation route rejects a missing authority confirmation. Privacy & Permissions may remember the visitor’s choice for the same private-processing purpose and exact Terms version, but it does not remember or infer authority for a new batch. The authority flag, Terms version and presented region are service-control evidence and are excluded from Analytics; before live generation, their exact retention and deletion operation must be approved and disclosed. Public visibility and optional Media + Shopping are per-look choices, never general saved permissions. The current preview does not store uploaded photographs on a Semper Eadem server. Before live generation is enabled, the selected business API provider, destination countries, security safeguards and exact source/output deletion periods will be named at the point of collection. Ordinary embedded photo metadata is removed by browser re-encoding before transmission. We prohibit facial recognition, biometric templates, general-model training and any advertising use by the generation provider.
AI content. Personal results are labelled “AI GENERATED · USER DIRECTED”; placeholder results are labelled “AI PREVIEW”. Public visibility remains off by default, and a visibility choice is not described as publication until moderation and public storage confirm it.
Public discovery, Instagram and search engines. “MAKE PUBLIC” on a particular kept look is available only after a separate unticked exact-look confirmation that its source photographs and every depicted adult are authorised for public website, @1886.London and search-engine use. If publication is confirmed, the look, its complete branded frame and related public page may appear on the official launch account and may be made available to Instagram or Meta recommendation, sharing and embedding features, Google, Bing and other search engines and image-search services. Ordinary Portal cards crop beyond that same frame, so the border, website and avatar stay outside the visible card until Share reveals the complete derivative. Other people may screenshot, download, copy, forward, repost, embed, crop, remix or edit publicly accessible copies. They do not receive ownership or blanket legal permission merely because the look is public. The publication record stores the Terms version, decision time, authority confirmation and confirmation that public distribution and search-discovery consequences were acknowledged. Removing the source from Semper Eadem or Instagram does not guarantee immediate removal from third-party results, caches, remixes or copies.
Optional Media + Shopping release and measured referral. A separate unticked choice permits the selected public look to be used in Semper Eadem organic and paid promotion, the media and editing formats listed in the Terms, and with BUY or PRE-ORDER beside it. Once recorded, it also creates a measured referral link tied to that look. The candidate system may count first-party visits, likes/unlikes, referred public UGC additions and attributable sales or reversals and place the results in the private CVO report. The report email is decrypted only after pseudonymous/protected scoring; no photograph or protected-trait inference is scored. A person decides whom to invite and what to offer. Refusing the release does not prevent private generation or ordinary public Portal publication. An ordinary share/candidate link does not itself grant rights.
Creator contact. The separate email form records the address only after an explicit contact choice and uses it for a possible private test or creator invitation. A link, score, email submission or level of activity does not guarantee contact, enrolment, a gift, payment or a specific offer.
Private shopping. The owner can buy or pre-order a product configuration inspired by a private look without publishing it. Only product configuration and stock identifiers go to the retail adapter, not the private image URL. A purchase, reward or artistic presentation never grants image, advertising or endorsement rights.
Public-look control and removal requests. At confirmed publication, the publishing browser may receive a random owner capability. The server stores its one-way hash with the public look ID, status, region presented at publication, publication-consent evidence and timestamps; the browser keeps the usable capability. It is not a login, cookie-based identity, face template or biometric identifier. A valid capability can restrict or delete only its matching look. Without it, the private Portal look control form collects the look reference, requested action, claimant role, reason, approximate date, contact email, written statement and optional proof.
Verification evidence. The contact email is used transiently to send a private verification and status link; the workflow database keeps a server-secret protected contact value, not the raw email. Optional screenshots, original-file evidence or authority documents are stored as private objects separate from public looks, never at a public URL. A social-profile link and temporary random code may be used as supporting proof of control, but social-media membership is not required. We do not use facial recognition, biometric matching or automated identity decisions.
GPT-assisted triage. Once a request is received, OpenAI’s API may receive a redacted version of the written statement plus the look ID, presented region, claim category, proof method and an inventory of evidence file types and sizes. The contact email, proof link and raw evidence files are not sent. The API request uses structured output and requests no application-state storage. OpenAI may nevertheless retain limited abuse-monitoring data for up to 30 days under its standard API controls unless the operator is approved for stricter data controls. GPT organises the case only; a person decides identity, authority, copyright, restriction and deletion.
Removal retention and access. Evidence files are scheduled for deletion 30 days after a final decision unless a longer legal hold is necessary. Minimal request, verification, decision and audit metadata may be retained for up to 24 months for accountability, an appeal, prevention of repeat publication or a legal claim. Access to the review queue and evidence requires a separate owner token; evidence downloads are private and are not exposed by public object URLs.
Client entrance. If a visitor requests client access, the purchase email is used transiently to locate a server-secret protected client identifier and to ask the approved email service to deliver a time-limited passwordless link. The entitlement database does not store the raw email, order reference or amount. It stores the protected identifier, confirmed purchase/credit ledger, expiring link token hash and session token hash. A first name supplied with a confirmed purchase may be stored encrypted solely to personalise the private client greeting; it is never sent to Portal Analytics. Shopify, principal-checkout and paid-preorder notifications must be signed and idempotent. Purchase history does not affect Portal ranking or public visibility.
Messaging preferences and birthday postcards. Future optional email is divided into birthday postcards, new stories and features, private invitations, and offers, launches and events. Every category starts off and uses a separate affirmative choice for the exact email address. Strictly necessary account, security, transaction, requested-service, rights and material legal messages are kept separate and contain no marketing. A purchase, account, referral, public look or Media + Shopping release does not subscribe a person.
If birthday email is selected, the planned service stores the supplied birthday day and month, not the birth year by default, together with the preference version, category, time, source and presented region. Optional locale or time zone is used only to schedule the greeting. The default card does not depict the recipient. A recipient likeness requires a separate active exact-person and exact-use image permission; either withdrawal stops future likeness postcards independently of the other choice.
The planned preference centre at /v25/subscription-preferences.html must provide essential-only, allow-all-email, per-category and one-step unsubscribe-all controls. Optional-email links use a protected single-purpose token and must not reveal a raw identifier. Withdrawal stops the affected future sends promptly. The minimum protected suppression record may be retained only as necessary to prevent further optional contact and demonstrate the request; birthday and preference data is deleted or de-identified under the approved schedule when no longer needed. Exact active, audit and suppression periods, the email provider, processors, regions, transfers and deletion controls remain launch blockers and will be disclosed before collection starts.
Optional email does not use tracking pixels or identified open/click measurement by default. Any later measurement requires a separate transparent choice. Raw email addresses, birthdays, message tokens, preferences, suppression entries and delivery outcomes never enter Site or Portal Analytics. Printed birthday postcards remain off until a separate postal choice, address notice, printer/fulfilment providers, delivery regions, returned-mail and deletion controls are approved.
Optional site and Portal analytics. Semper Eadem uses first-party analytics only after a visitor chooses “Allow analytics”. Across the public website, the purpose is to understand which traffic channels, pages, story sections and non-personal postcard/campaign editions hold useful attention, lead toward the Portal or show gentle commercial interest, and where the experience is slow or fails. Inside the Portal, the three confirmed outcomes remain completing a personal look, confirmed public publication, and a verified follow of @1886.London. Page views, engagement, postcard arrivals, previews, visibility choices, Portal openings, commercial-interest clicks and profile clicks are proxy or diagnostic signals and are never described as completed goals.
Ordinary website and Portal browsing is silent: scrolling, viewing or tapping through looks never opens an analytics request and never counts as consent. Optional analytics stays off unless you deliberately open Privacy & Permissions and enable it. When you choose an action that genuinely needs permission—such as processing a photo privately or making one exact look public—the Portal asks only for the separate permissions needed for that action. Photo processing, Terms acceptance, publication, Media + Shopping and referral choices are never granted by browsing or by an analytics setting.
Consented events contain a random per-tab session identifier, controlled page and section keys, desktop/mobile surface, event time, coarse channel, an external referring hostname without its path or query, controlled campaign/content/postcard edition codes, scroll or engagement bands and coarse performance/error categories. Where relevant, Portal events also contain the test variant and an approved editorial-look identifier. Photographs, image contents, names, email addresses, client/candidate identifiers, order references, purchase values, full URLs or query strings, referrer paths, form or DOM text, error messages or stacks, Instagram identities, protected characteristics and unrestricted free text are not sent. A postcard or campaign code must identify an edition, never an individual recipient. Raw consented events are retained for up to 90 days; daily site, funnel and approved external aggregates may be retained for up to 24 months, and non-personal lifetime statistics for Semper Eadem’s own editorial looks may remain while those looks are used in the Portal.
The lawful basis for optional browser analytics in consent-based markets is consent. Hosting and database infrastructure providers process the data on our behalf. Search Console and infrastructure figures may be added to the owner report as daily aggregates without joining a visitor identity; unrestricted raw search queries are not imported. Cloudflare Web Analytics, Google Analytics or another external browser connector remains disabled unless its exact provider, purpose, regions, transfer and retention information is approved and disclosed before data is sent. Consent can be refused without losing website or Portal access and changed at any time through Privacy & Permissions. Withdrawal stops future optional collection and clears the tab-scoped analytics session and campaign attribution. We do not sell personal information, share it for cross-context behavioural advertising, or use targeted-advertising cookies. Global Privacy Control is recognised; optional analytics stays off while it is active until an approved country-and-provider rule confirms that a separate first-party analytics choice may be offered.
Regional presentation. The hosting network supplies a coarse request-country result so the Terms can show one likely regional addendum. The Portal analytics described above does not receive or store the visitor’s IP address or request-country result. Network location is only an interface default: residence, travel, a VPN, business establishment or the market being served may produce a different legal result. Visitors can select a different region or show every addendum in the Terms & Conditions.
United Kingdom
Where applicable, UK data-protection and consumer rights remain available. Consent for optional analytics, electronic-mail marketing and promotional use is separate from access to the Portal. Optional email uses a clear affirmative category choice unless a specifically documented current exception lawfully applies; every optional email includes an easy opt-out. Unfair or hidden terms are not made valid by inclusion in a broad agreement.
EU / EEA
Where applicable, you may request access, rectification, erasure, restriction, portability or object, withdraw consent, and complain to your local supervisory authority. It must be as easy to withdraw consent as to give it, and an objection to direct marketing stops that processing. We normally answer a sufficiently verified rights request within one month, subject to lawful extensions and exceptions. International transfers require an applicable transfer mechanism and safeguards. No solely automated decision in the Portal produces legal or similarly significant effects.
United States
Applicable state rights may include access/knowledge, correction, deletion, portability and opt-out rights, without discrimination for exercising them. Commercial email must identify the sender and provide a clear functioning opt-out; applicable federal rules require qualifying opt-outs to be honoured within 10 business days, while Semper Eadem applies any shorter binding deadline. For California requests within the CCPA, we generally acknowledge receipt within 10 business days and respond to a verified request within 45 calendar days, subject to permitted extensions and exceptions. A privacy/likeness request and a copyright or DMCA notice are assessed under their separate legal routes. We honour Global Privacy Control. We do not intentionally collect children’s photographs, sell personal information, use cross-context behavioural advertising or derive biometric identifiers.
Canada and Québec
We provide meaningful, layered consent; limit collection, use and retention; and support access, correction, withdrawal and complaints. A commercial electronic message requires the applicable consent basis, sender identification and an unsubscribe mechanism; qualifying unsubscribe requests must be applied within 10 business days or any shorter binding deadline. Consent may be withdrawn subject to reasonable notice and lawful or contractual limits. We respond within the period required by applicable federal or provincial law after sufficient verification. Privacy is highest by default. Before personal information is communicated outside Québec, the required privacy impact assessment and written safeguards must be completed.
Japan
Applicable privacy, consumer and advertising protections remain available. Personal information is limited to the disclosed purposes, processors and overseas handling require appropriate oversight and notice, and brand-controlled promotion must not mislead people about its advertising character. Email advertising remains disabled until the consent evidence, sender information, conspicuous refusal route, required records and current local review are complete; a request to stop direct marketing is handled promptly.
Recommendation notice
The Portal first creates candidate groups from approved editorial work, fresh moderated public work, personal results, proven aggregate engagement and a small exploration pool. It then scores meaningful viewing, likes, shares, skips and bounded progress toward the three Portal goals, before re-ranking for moderation, public status, freshness, no repetition, and colour/style variety.
The feed does not use uploaded photo contents or infer protected characteristics to rank people. Every visitor uses the same candidate, scoring and re-ranking architecture. Experiments may change when a prompt appears, but cannot change privacy defaults, invent a completed goal or use a dark pattern. More popular work is not guaranteed placement.
